连鹏：尊重生命 让歧视远离艾滋病人

安徽省安庆市一名大学生参加了当地今年举行的教师招录，因艾滋检查呈阳性后遭拒录，于是愤而起诉当地教育局。近日，此案在安徽省安庆市迎江区法院开庭审理。法律界人士认为，在我国，艾滋病患者在就业、教育和医疗方面面临着严重歧视，此案的审理意义重大。
2006年颁布的《艾滋病防治条例》规定，任何单位和个人不得歧视艾滋病病毒感染者、艾滋病病人及其家属。而人事部和卫生部新出台的公务员录用全国统一体检标准，也已经删除了之前“艾滋病病毒携带者不合格”的表述。温家宝总理过去7年来都专门考察艾滋病防治工作，还把艾滋病致孤儿童和患者请到中南海参观座谈。而安庆市教育局拿孩子和家长无法接受艾滋病患者老师，以及“公务员体检标准及公务员录用体检通用标准”作为拒录理由，反映出艾滋病患者在就业等方面仍然面临着严重歧视。
这种歧视是不会自动消失的，只有社会各方共同努力，特别是政府和立法者加以规范并身体力行，才能起到正面引导作用。同时，政府的责任也不仅仅限于通过立法消除雇主的歧视，保障艾滋病患者合法的工作权利，更重要的是通过教育和媒体改变社会中的歧视态度。
在安庆这起就业歧视诉讼案的相关报道中，有一位不愿透露姓名的法律工作者表示，他反对艾滋病歧视，也同情当事人的遭遇，但作为一个家长，他还是接受不了一个艾滋病病毒感染者站在讲台上的现实。
这位法律工作者的言论，很真实地反映了一部分人的心态。在现实社会中，歧视问题是法律层面无法彻底解决的。国人凡事先求自保，当事不关己时，可以表示出无限的宽容，而一旦影响了自己，却唯恐避之不及。在我们的社会中，充满了太多的隐形歧视，比如性别歧视、地域歧视、社会身份歧视、户籍歧视等，即使属于少数现象，也是当下社会正在发生的现实。
要彻底消除歧视，政府应该肩负首要责任，但也需要全社会的共同努力。作为普通公民，也有义务从道德层面摘掉有色眼镜，以宽容和尊重的角度，去接纳包括艾滋病患者在内的弱势群体。一个合格的公民，不仅是善于保护自己的权利，同时也要有尊重他人权利、平等对待他人和积极主动关怀社会的人本情怀。
目前社会中对艾滋病的恐慌主要来自于谣言。近几年来，艾滋病的治疗在技术上已经取得了重大的突破，科学家早已不把艾滋病看成是“不治之症”了。只要坚持正规治疗，患者可以带菌长期生存。艾滋病只是一种慢性疾病，但来自社会的冷漠和歧视，却将不少艾滋病患者逼成“精神绝症”。
记得姚明当年与魔术师约翰逊一起所做的公益广告，使更多人关注到艾滋病患者的生存现状。在国内，艾滋病长期以来一直是耻辱的标志。不过近些年人们的态度开始发生变化，政府也开始更开明地讨论艾滋病防控问题。艾滋病由被清除到被接纳，显示了国家和社会在维护人的尊严方面的进步。
当一个人感染了艾滋病毒，可以坦然地告诉家人、朋友、老板，告诉身边的每个人，而大家也可以平静地接受，并给予足够的尊重和帮助，这样的社会才是真正充满关爱的社会。每个公民的实际行动，可以滴水穿石地改变整个国家对艾滋病的看法，化解弱势群体的困境。而只有社会的大环境充满希望，每个个体才能真正地看到希望。
