首例艾滋隐私被泄案今天开庭

本报讯 被媒体称为国内“首例艾滋隐私被泄案”和全国第二例艾滋就业歧视案将于今日上午8点半在四川攀枝花盐边县法院在开庭。
2010年6月，小军（化名）报名参加了盐边县事业单位音乐教师岗位考试。笔试、面试通过后，在体检过程中检测出HIV呈阳性被拒绝录用。在交涉过程中，小军的个人隐私又遭教育局、人事局泄露。2010年10月20日，在北京益仁平中心的协助下，小军将盐边县教育局、人事局告上法庭，要求判令被告盐边县教育局、人事局不予录用原告的行为违法，责令被告重新录用原告，同时对泄露原告隐私的行为进行赔礼道歉、消除影响。
原告小军在行政起诉状中说，2010年8月9日他报名参加被告组织的盐边县招聘教师考试，以综合分数名列第二的成绩进入8月20日的面试，通过面试入围体检名单，体检后被通知参加盐边县教育局组织的新教师岗前培训，培训结束后又通知他进行身体复检，并电话通知他到×××校报到任教。事隔三天，该校校长电话通知他体检不合格，并强调体检不合格不予录用。经他向盐边县人事局、盐边县教育局反映，两被告称学校属特种行业，以他体检不合格为由不予录用。两被告还召集信访局、民宗局、派出所、纪委、疾控中心等单位公开他的隐私，侵犯了自己的隐私权。
因此小军认为，根据我国宪法第三十三条、四十二条以及相关法律规定，公民有平等就业的权利，任何单位和个人不能侵犯公民的平等就业权。我国《劳动法》第三条、第十二条规定，劳动者享有平等就业的权利，劳动者就业不应受到歧视。2008年1月1日起实施的《就业促进法》规定：“用人单位招用人员，不得以是传染病病原携带者为由拒绝录用。”即艾滋病毒感染者（携带者）依法享有平等就业的权利。
《中华人民共和国传染病防治法》第十六条规定：“任何单位和个人不得歧视传染病病人、病原携带者和疑似传染病病人。”《艾滋病防治条例》第三条也明确规定：“任何单位和个人不得歧视艾滋病病毒感染者、艾滋病病人及其家属。艾滋病病毒感染者、艾滋病病人及其家属享有的婚姻、就业、就医、入学等合法权益受法律保护。”即任何单位和个人不得歧视艾滋病毒感染者，其享有的就业合法权益受法律保护。
被告在公开招聘教师的体检中对小军进行了HIV检测，获取了小军的身体隐私信息。并以他是艾滋病毒感染者（携带者）为由认定其体检不合格，从而使他失去了被聘用为教师的机会，违反了相关法律不得歧视艾滋病病毒感染者的规定，侵犯了他依法享有的平等就业的权益。

国务院要求保障艾滋感染者权益
