员工冒充患艾滋病客人敲诈酒店经理

时报讯 李某，24岁，男，陕西人。初中毕业后就来余杭打工，曾在余杭某假日酒店桑拿部工作。
因为敲诈东家，近日李某被余杭区人民法院，以敲诈勒索罪判处有期徒刑二年六个月。
2009年1月，李某应聘到余杭某假日酒店桑拿部工作，月工资1500元左右。上了一个月左右的班后，一次洗澡时，李某发现自己的下身又痒又湿，感觉得了什么病。
李某不敢去正规医院看，记起在路边电线杆上，看到有关于性病的咨询电话，于是他打电话过去咨询，他还打过收音机里的一些咨询电话(电话号码和电台，李说都不记得了)，在电话咨询中他被告知可能是得了性病。
他躺在床上，一个人越想越慌，想当然地认为，说不定是在桑拿部打扫包厢时，被包厢里的钉子划破手，说不定又有艾滋病的客人遗留在床单上的血迹，说不定自己的伤口又恰好碰上血迹而被感染了。
这么多个“说不定”加在一起，李某觉得这就是真的了。他决定冒充桑拿客人，让桑拿部的负责人赔钱。
2009年4月初，他到一个卖手机的小店里买了一张不用身份证登记的手机卡，并就这张电话卡发短信给桑拿部付经理。
短信中，李说自己曾是该假日酒店桑拿部的客人，洗澡时得了艾滋病，要酒店赔偿，如果不赔偿就向公安举报，要报110，报新闻媒体，还说在这家酒店里装了探头，发现里面有毒品，如果不赔偿给钱，就弄得这家店开不好，让这家店在5月10日前关门，让她去坐牢。
期间，为了给酒店施加压力，李还报过110，还打过新闻媒体的举报电话，都是谎报有人在酒店里吸毒，可是付经理一直没有给她回信。
4月22日，付经理发短信给李某，说打了2000元在他报过来的银行卡里，23日早去取钱时被公安机关抓获。
在李某的审讯笔录中，李某一直称桑拿部的付经理对手下很好，如果没钱用还会让员工提前预支，但在公安干警问他为什么还要这样做时，李某一直低头不语。
在法庭上，李某对指控的犯罪事实都认罪，也没有对罪行发表任何辩论意见，只是补充说明了一点，说要8万是说说的，给多少看桑拿部人员的良心。
法官手记：
近段时间来，员工因对单位不满，因自己手头拮据，因对老板怀恨在心等原因而采取行动报复或敲诈的刑事案件较多。对老板或单位而言，建议对员工要加强对员工的道德教育和人身修养的培训，不要节省这些开支，思想健康的团队更具有市场竞争力，更能创造积极向上的工作氛围。
对于员工而言，不管你与老板或单位有什么意见，可以开诚布公地提出自己的想法或建议，如果真的觉得不适合某个工作岗位，也可以考虑换个单位，但无论如何，不能自暴自弃，采取触犯刑律的方式去打击报复或赚取非法利润，毕竟法网恢恢、疏而不漏，做了坏事总是会得到惩罚的，这样做得不偿失，对你的人生会有很不利的影响。（时报记者 陈逸清 通讯员 余法）
