仪器偏差一点 健康人可能误为艾滋病

本报讯 （记者 熊德壮 实习生 毛佳）菜市场的秤是否“短斤少两”？医院、加油站的计量仪器是否准确？已经实施14年的《成都市计量管理监督条例》（以下简称《计量条例》），实施效果怎么样？昨天，市人大常委会首次实施地方法规立法评估，举行《计量条例》立法评估座谈会第一次座谈（医疗卫生机构座谈会），质监部门、医院、人大代表和专家聚集一堂，对该条例实施效果“品头论足”。
首次立法评估选定“计量”
“立法评估相当于评价法规这个‘标尺’合不合格。” 市人大法工委主任委员陈雪林说。立法评估，即是对立法质量和实施效果进行系统分析，哪些方面好哪些地方不足，以利于改进立法程序，提高立法质量和实施效果。
立法评估包括立法前、立法中、立法后评估。根据去年8月市人大常委会出台的《关于提高地方立法质量有关事项的决定》，法规实施3-5年后要视情况进行评估。
首次接受立法后评估的法规，是1996年出台的《计量条例》。“菜市场的电子秤，水、电、气表，医疗仪器，直接关系到市民的‘钱袋子’甚至生命安全。比如检测血液的仪器量值准确度稍偏差一点，健康人也可能整成艾滋病。”有关人士说。
乡镇医院受检率有待提高
出台14年，《计量条例》实施后效果到底怎么样？在昨日围绕医院计量进行的第一次立法评估座谈会上，市质监局局长周道富表示，该条例颁布实施以来，全市医疗卫生机构计量器具强制检定受检率不断提高，成都医疗机构计量器具的周期受检率在15个副省级城市中名列前茅。去年，全市市级、县级医院在用强制检定计量器具受检率都达到100%；乡镇医院在用强制检定计量器具受检率95.8%。去年622家医疗机构在用计量器具周期受检率达97.11%。
周道富说，下一步，质监部门将加强乡镇医院的计量监管，提高乡镇医院医疗计量的受检率。
代表呼吁降低检定费
一些与会医院代表和专家就条例的实施等提出了建议，呼吁降低医疗计量器具检定费。
成都市三医院代表李喧认为，现在对医疗计量器具检定费太高，希望这笔费由政府买单或者通过其他方式降低。川大教授汪良吉认为，现在医疗设备发展很快，列入监督的计量器具目录存在滞后性；同时，一些新的医疗设备出厂时经强制检定合格的，进入医疗机构质量应该被认同，不必重复检测，医疗计量器具检定费用的调整应与医疗收费标准相一致，这样可不增加医院负担。此外，市血液中心主任医师孙启凤认为，应加强“高、精、尖”进口医疗设备的计量管理，建立健全相关技术标准和强检能力。
市人大代表石建辉表示，“对于医疗系统来说，《计量条例》是一个涉及健康、减少医疗纠纷的条例，但现在的质检程序不规范，相关部门应该制定一个统一的质检程序。”
评估发现的问题要整改
据悉，本月中旬和下旬，市人大常委会还将分别举行该条例立法评估的集贸市场计量座谈会和计量技术机构座谈会，就该条例的实施效果、存在的问题、公众反映等听取意见。评估报告将在10月份与市政府关于该项法规实施情况的报告一起，提交市人大常委会审议。对立法评估发现的问题，评估结果作出的各项对策、建议，实施法规的政府部门应当及时制定相关政策，采取有力措施，切实整改和改进工作。
有关人士表示，从其他省市的经验看，实施立法后评估，为修订法规做准备是其主要目的之一。至于成都《计量条例》是否修订，还要视评估结果而定。
