男子献血后被误查出感染艾滋 维权一年无结果

2009年11月的一天，来常州打工的吴先生在献血车上献血。结果几天后，被老家邳州市疾病预防控制中心告知其感染了HIV病毒。这一消息犹如晴空霹雳，令他惊愕不已，因严重影响生活一度想轻生。可吴先生几番周折后，前往江苏省及徐州市疾病预防控制中心，两次权威检测给出的结果都是“没问题”。事后吴先生得知，血站只检测一次就判定自己感染艾滋病毒是违反国家规定的，一怒之下向疾控部门索赔，但是忙了一年多，什么效果都没有。无奈的吴先生只能向本报投诉，记者展开了调查。

虽然“被艾滋”，但真的很吓人
吴先生是邳州人，2004年来常州打工，2009年11月在超市附近献血车献了血。几天后，吴先生突然接到了老家邳州市疾病预防控制中心打来的电话，通知他感染了HIV（艾滋）病毒，需要赶紧来邳州疾控了解“艾滋病人注意事项”。.
吴先生一下子蒙了，赶紧去查资料得知：一个人被感染艾滋病一共有三个途径：母婴传染、性途径传染、输血。这三点都不符合啊。吴先生赶紧辞职赶回邳州。
吴先生回忆，在邳州市疾控中心，他拿到了邳州疾控中心下发的“HIV抗体阳性者通知书”。还是不相信的吴先生要求复检，被疾控中心拒绝了。工作人员当时的说法是，你得艾滋病的消息，是从卫生部的网站上查出来的，是比较权威的，不需要再做复检。而后，还特意给他看了网站上的一份编号为320402040-2009-00015的“传染病报告卡”。吴先生一下万念俱灰。回家后还得知，邳州市疾病预防控制中心已经把电话打给了他父母，父母伤心得好几天吃不下饭。绝望中的他买了一瓶安眠药放在柜子里准备自杀。幸好，父母时刻不离开他，吴先生最终没机会做傻事。
冷静下来的吴先生还是心有不甘，觉得不能死得不明不白。抱着最后一丝希望，他先后去了徐州市疾控中心和江苏省疾控中心筛查。结果，这两个权威检测机关给出的结果都是“没有感染”！拿到阴性检验报告，吴先生喜极而泣。
虽然没事了，但维权的路很难走
事实证明，自己是“被艾滋”了。健康是没事了，但这一场精神和肉体上的损伤，还有辞职的损失，是不是该由误诊者负责？气愤的吴先生到邳州市疾控中心“讨说法”，但疾控中心的工作人员推说，责任在于给报告的常州市中心血站。找到常州市中心血站，血站理直气壮表示称自己是按照“卫生部规定程序”办事的，责任不在他们这边。
被踢了皮球的吴先生只好拿起法律武器。吴先生请了常州一位杨律师做自己的代理人，律师说，疾控部门在没有得到确切结果的情况下就草率下发了通知书，这给吴先生及其家人带来恶劣的影响，理应给予一定的经济赔偿。
吴先生说，杨律师接案子后开始调解，刚开始对方答应赔偿3万，杨律师觉得太少便回绝了。不过，从此以后吴先生他再也没有得到任何关于这件案子的消息，多次打电话杨律师一直没有给一个明确的答复。时间过去近一年，也没个定论，再后来他打电话给杨律师，律师索性也不接了。一气之下，他就直接跑到杨律师的办公室与其解除了合约关系。吴先生说，杨律师告诉他，案子十分复杂，由于涉及的单位和个人比较多，所以处理起来也十分麻烦，更主要的是这件案子“容易得罪人”，所以自己“无能为力”。
记者再度追访两个相关单位
常州中心血站：
血站只负责检测，问题出在疾控上
为了进一步核实吴先生所反映的情况，记者首先与最先检测的常州市中心血站取得联系。
“我们血站做的只是初筛，没有最终确诊权”。常州中心血站的张书记告诉记者，当初他们筛查时发现有阳性反应后，按照卫生部的相关要求，必须把吴先生的个人信息，输入卫生部网站上的传染病信息管理系统。随后系统自动会把这个信息反馈到吴先生的家乡的邳州市疾病预防中心来复查。
至于检测时误判，张书记解释说，假阳性是艾滋病检测里经常遇到的。张书记认为，吴先生原籍所在地的邳州市疾控中心应该先复查和确证后再做最终判断，而不应该仅凭血站的初查结果直接就下发确证通知书。
邳州市疾控中心：
卫生部网站说是阳性，所以没复检
记者又联系上了邳州市疾病预防控制中心。一位自称姓张的主任告诉记者，当初他们在卫生部的网站上查到了常州市中心血站上报的吴先生的传染病报告卡，这份传染病报告卡中写有“在艾滋病实验室检测结论中明确注明确认结果阳性”，他们认为这是一份权威的报告，所以他们也就没对其进行复检。
权威部门说,确证程序应该是这样的
不过，这位“张主任”的说法并不符合艾滋病检测规范。记者联系常州市疾病预防控制中心，该中心性艾科工作人员告诉记者，确定一个人是否感染艾滋病毒，有严格的程序：初筛发现阳性，就应该进行二次复查。复查还是阳性，就必须上报到有资格的确证实验室作确证检测，只有确证检测仍然是阳性的情况下，才能下发感染通知书。常州市血站是有初筛资格的，但是他们初筛阳性的结果未经复检，不可能成为“权威结论”。
记者随即又询问了更为权威的部门，江苏省疾病预防控制中心性艾科确认，常州市疾控中心的说法是正确的。省疾控工作人员还告诉记者，目前，省里有初筛资格的实验室虽然有510个之多，但是有资格“确证”艾滋病毒感染的，只有包括省疾控在内的13个确证实验室。常州市血站和作为县级市下属的邳州疾控中心都有初筛资格，但是都没有确证资格。也就是说，邳州市疾控在未经过一次复检的情况下就下发那份“阳性通知书”是违规的。
法律界人士接受记者采访时也认为，在吴先生“被艾滋”事件中，血站无责，而邳州疾控存在过失，理应赔偿。
血站为何没责任？
明明血站检测就错了，为什么没责任呢？江苏省血液中心业务主管魏主任介绍，献血前必须要做乙肝、丙肝、梅毒和HIV筛查，有的献血者会查出反应性阳性（假阳性），这是因为血站的检查设备相对灵敏度高，对于饮酒、服药、疲劳、吃海鲜者都有可能干扰检验结果，出现反应性阳性。
根据血站质量管理规范，对阳性反应性献血者都要设“献血屏障”，列入“黑名单”，永久不能献血。并且，江苏血站已经全部联网，被误入黑名单者到哪里都不能献血。他还说，初筛阳性的，血站必须向疾控中心汇报复查。
邳州疾控错在哪？
记者从省疾控中心性艾科获悉，现在，江苏各级疾控、多个二级以上医院和采供血机构都可以进行艾滋病的筛查检测。但是否感染艾滋病的“终审判决”，需要经过艾滋病确证实验室的确认。目前，全省艾滋病检测网络现已扩展到1个省级确证中心实验室、12个确证实验室、13个市级筛查中心实验室以及510个筛查实验室。而邳州市疾病预防控制中心并不属于确证实验室。
同时还有业内人士告诉记者，把怀疑艾滋病感染的消息告诉吴先生父母的做法，也是不合乎规范的。
