  因艾滋病检测呈阳性,小吴(化名)在教师招聘中被拒,于是他将安庆市人社局和教育局告上法庭。今年1月20日,这起备受关注的“艾滋病就业歧视第一案”二审上诉人败诉,但案件并未就此尘埃落定。日前,小吴再次就自己的劳动就业权寻求救济,向安徽省人民检察院提起了再审的申请。
  4月25日上午,小吴通过代理律师郑继能向安徽省人民检察院提起了再审的申请,希望检察机关依法抗诉。申诉人小吴认为,教师招聘不应当适用公务员体检标准,二审判决越权行使了立法权和行政权。 
  申诉书认为,平等就业的权利是公民的基本权利,任何单位和个人不能侵犯公民的平等就业权。疾病患者或是传染病病源携带者在就业方面的限制必须由法律或法律授权的部门做出规定,其它任何部门、包括人民法院都无权根据现有法律规定来推定传染病及病源携带者不能进入的行业。(乔剑)
