艾滋病就业歧视案原告再次寻求法律帮助2011年04月29日 15:21

晨报讯 本报曾连续报道的国内首例艾滋病就业歧视案二审上诉人败诉后，此案并未“盖棺定论”。在劳动节即将到来之际，艾滋病病毒感染者小吴再次就自己的劳动就业权寻求法律的帮助。
4月25日上午，小吴通过代理律师郑继能向安徽省人民检察院提起了再审的申请，希望检察机关依法抗诉。申诉人小吴认为，公务员体检标准不适用于教师招聘，二审判决越权行使了立法权和行政权。

申诉，即申请再审，对于符合法律标准的案件法院可以启动审判监督程序对案件重新审理，作为监督机关的检察院也可以提出抗诉。郑律师表示，之所以通过检察院提出抗诉，是希望尽快启动再审程序，尽早还小吴平等就业的权利。
“教师身体能力依据什么标准？由谁来制定这个标准？” 23岁的小吴称，二审败诉后，他即表示要申诉， 要“争争这口气”。
郑继能认为，被申诉人安庆市教育局在招考、录用教师时违反了《就业促进法》和《艾滋病防治条例》。同时，《就业促进法》、《传染病防治法》都明确规定疾病患者“禁止从事的工作”由法律、行政法规或卫生部规定，实际上这两部法律也是关于平等就业及身体条件要求的最高法律，除此之外，其他任何部门、任何与此有关的规定都是无效规定。
小吴的另一位代理律师李方平认为，“《教师法》、《教师资格条例》都没有授权教育部制定教师身体条件标准”。
同时，中级法院认为只要《教师资格条例实施办法》与《教师法》、《教师资格条例》相一致，就属于符合法律行政法规规定。李方平认为这显然“以偏概全、张冠李戴”。本报记者 艾裴
