[岳屾山点评]维护艾滋病人依法应享有公平就业权利

【事件】“用人单位招用人员,不得以是传染病病原携带者为由拒绝录用。”这段文字2007年被庄严地写入《中华人民共和国就业促进法》中。然而在现实生活中,依然有一些特殊人群在就业中遇到了种种阻力和困扰。
安徽安庆的应届毕业生小吴就是其中的一位。他的理想是做一名教师,经过了笔试面试,却在体检时因为“艾滋病检测呈阳性”被挡在安徽安庆教育局教师招录的门外。 【中国首例艾滋病病毒感染者就业歧视案13日开庭】
中广网北京10月13消息 中国政法大学民商经济法学院金英杰副教授说,要遵照法律法规消除对艾滋病人有关就业的歧视。对此,中国之声特约观察员岳屾山特作如下点评。
岳屾山:据悉,我国首例艾滋病病毒感染者就业歧视案将于今日开审。本案中原告因体检艾滋病检测呈阳性而在教师招聘中被拒,遂起诉教育局要求法院判令被告安庆市教育局认定原告体检不合格不予录用的行为违法;请求责令被告重新作出对原告的具体行政行为。这是继“乙肝歧视案”、“基因歧视案”后又一重要就业歧视案件,它的审理引起了社会的广泛关注。
首先,关于教育局作为事业单位参照公务员的录用标准,是否合法这一问题,我们认为,如果事业单位招聘时没有标准,可以参照其他标准。但参照标准中如果有违反法律或与法律法规抵触的地方,应遵守法律法规。
其次,对于《公务员录用体检通用标准(试行) 》和《公务员录用体检操作手册(试行)》规定艾滋病不合格的内容,我们认为,我国2006年3月1日起实施的《艾滋病防治条例》和2008年1月1日起施行的《中华人民共和国就业促进法》均对艾滋病毒感染者的平等就业等权利有明确的保护。尤其是《就业促进法》第三十条规定“用人单位招用人员,不得以是传染病病原携带者为由拒绝录用。”更是对用人单位因传染病原因对应聘者进行就业歧视的行为加以禁止。
